These Terms of Service ("Terms") govern your use of the website and services operated by Velocity Point, LLC ("Revenue Point," "we," "us," or "our"), including revenue-point.com.
Acceptance of Terms
By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Services
Revenue Point provides performance-based database reactivation services: AI-powered outreach that re-engages your existing lead database and books qualified conversations into your sales calendar. Specific service terms, pricing, and service level agreements are provided separately upon enrollment and in our Service Agreement.
User Accounts
When you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
Intellectual Property
All content, features, and functionality of our services are owned by Velocity Point, LLC and are protected by copyright, trademark, and other intellectual property laws.
SMS Messaging Terms
By submitting your phone number through a Revenue Point form and opting in, you give your prior express written consent under the federal TCPA (47 U.S.C. § 227) to receive recurring SMS messages from Revenue Point about your inquiry, demo, or account, including messages sent using automated technology. Consent is not a condition of any purchase. Reply STOP at any time to opt out, or HELP for help. Message and data rates may apply. Full SMS-program terms are in our Privacy Policy.
Acceptable Use
You agree not to use our services to:
- Upload lead lists you do not own or for which valid consent does not cover SMS or email re-engagement;
- Violate the TCPA, CAN-SPAM, state mini-TCPA statutes, or any other applicable law;
- Send messages to numbers on the federal Do-Not-Call registry without a valid established business relationship;
- Reverse-engineer, scrape, or attempt to gain unauthorized access to our systems.
Disclaimer of Warranties
The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Revenue Point does not guarantee any specific reactivation rate, reply rate, booking rate, or revenue outcome — results vary by industry, list quality, offer, and execution.
Limitation of Liability
To the fullest extent permitted by law, Revenue Point and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, lost revenue, or lost data) arising from your use of our services, even if Revenue Point has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Velocity Point, LLC and its officers, members, employees, and contractors from any claims, damages, regulatory penalties, or attorneys' fees arising from: (a) your breach of these Terms; (b) any TCPA, CAN-SPAM, or state-mini-TCPA claim relating to a lead list you uploaded; (c) any claim that a contact in your list did not provide valid prior express written consent for the channel of outreach; or (d) any claim arising from your underlying product, service, or fulfillment to a lead booked through our services.
Termination
We may terminate or suspend your access to our services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Dispute Resolution
Before filing any lawsuit, the parties will attempt to resolve disputes through good-faith negotiation for thirty (30) days, then through mediation with a mutually-agreed mediator for an additional thirty (30) days. This informal-resolution requirement does not apply to claims for injunctive relief to protect intellectual property or confidential information.
Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Exclusive venue for any dispute arising from these Terms or your use of our services lies in the state or federal courts located in Clark County, Washington, and the parties consent to personal jurisdiction in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website.
